TERMS AND CONDITIONS OF THE AGREEMENT

TRAVEL INSURANCE & LUGGAGE:

    1. A basic Vehicle Insurance covers the campervan only. Should it be required to evacuate the Traveller, it shall be the Travellers’ responsibility to ensure that sufficient medical and travel insurance is in place for any hospital/medical expenses and associated costs.
    2. Weight & Volume restrictions for baggage may apply on our Campervan. Please check with the Boondockers team for details of the same.
    3. Safekeeping of baggage & personal belongings shall at all times be the Travellers responsibility. BOONDOCKERS will assume no liability for lost or damaged baggage/belongings under any circumstances.
  1. MARKETING & PROMOTIONS:

BOONDOCKERS reserves the right to take photographs/videos during the operation of any trip and use them for promotional purposes. By booking a trip with BOONDOCKERS, it will be deemed that travellers have consented to the use of any photographic images/videos taken of them/vehicle whilst on the trip. Travellers who prefer their images to not be used should identify themselves prior to final payment to be exempted from the photography waiver clause.

  1. PRICING:
    1. Prices for all Trips are for up to 4 travellers only unless explicitly stated otherwise.
    2. Prices include Boondockers fee for planning and arranging itineraries, handling charges including preparing/loading the campervan and operational charges.
    3. Price includes travel & stay in the Campervan only. .
  1. EXCLUSIONS:
    1. Meals are not a part of the above package.
    2. Does not include additional expenses including but not limited to fuel, state entry tax, tolls, overnight parking charges, water re filling charges if any, external power connection charges if any, etc.
  1. BOOKING PROCESS:
  1. Booking a Trip can be done by interacting with our office. The Traveller is responsible for confirming the itinerary to Boondockers in writing by e-mail to enable Boondockers to make the required arrangements.
  2. BOONDOCKERS will extend provisional bookings subject to availability.
  3. BOONDOCKERS reserves the right to release provisional bookings.
  4. Upon confirmation, the traveller’s passport nationality will be required (in case of foreign nationals) Any valid government issued Photo ID for (Indian Nationals). This information will be used solely for submission to law enforcement agencies and for determination of entry/activity fees as applicable.
  5. Reservations are confirmed on receipt of 100% payment as per the below mentioned guidelines –
    • Short trip (up to 2 days) – 100% payment to be made 4 days before the commencement of the trip.
    • Medium trip (3 to 4 days) – 100% payment to be made 7 days before the commencement of the trip.
    • Long trip (5 days and above) – 100% payment to be made a minimum of 10 days before the commencement of the trip.
  6. All bookings are subject to our cancellation policy.
  7. The final invoice will be sent to the travellers by email within 72 hours of completion of the Trip.
  1. AMENDMENTS, REFUND AND CANCELLATION POLICY:

 

  1. All amendments to a travel plan and itinerary are subject to our Cancellation policy
  2. Refunds will not be made for any missed services in respect of the trip.
  3. Bookings that are being made more than 14 clear days prior to the travel date can be confirmed by paying a booking amount of 30% of the rental charge. This booking amount is non-refundable and shall not fall under any of the below mentioned cancellation rules.
    1. The balance 70% needs to be paid by or before 14 clear days prior to the travel date.
    2. Failure to do so will result in the cancellation of the trip and releasing of the dates.
  1. In the event of cancellation or rescheduling of a booking, BOONDOCKERS shall be entitled to retain such portion of the booking as prescribed below:

Up to 14 clear days or more prior to travel date –

  • Cancellations – Full refund (Excluding the booking amount, IF applicable). Security deposit (IF paid) shall be completely refunded).
  • Rescheduling – No change fees. New travel dates must be within 30 days of original travel date. New dates subject to availability and fare difference if applicable will need to be paid. However, if the new rental is lesser, no refunds shall be given of the balance amount.

Up to 13 to 8 clear days prior to travel date –

  • Cancellations – 50% rental will be retained by us (Excluding the non refundable booking amount, IF applicable). Security deposit (IF paid) shall be completely refunded.
  • Rescheduling – No change fees. New travel dates must be within 30 days of original travel date. New dates subject to availability and fare difference if applicable will need to be paid.
  • However, if the new rental is lesser, no refunds shall be given of the balance amount.

Up to 7 clear days or less from travel date –

  • Cancellations – 100% of the rental paid will be retained by us. Security deposit (IF paid) shall be completely refunded.
  • Rescheduling – Only 50% of rental paid can be used towards new travel dates. New travel dates must be within 30 days of original travel date. New dates subject to availability and fare difference if applicable will need to be paid.
  • However, if the new rental is lesser, no refunds shall be given of the balance amount.

 After commencement & during travel –

  • Cancellations – 100% of total Trip price will be retained by us. Security deposit shall be refunded after making deductions IF applicable.
  • Rescheduling – No rescheduling allowed.
  • Extensions – Subject to availability.
  • For extended dates regular tariff will be applicable.

Refundable Security deposit must be paid by or before 24 hours prior to the start time of the trip.

  1. In case the trip needs to be cancelled or rescheduled due to a travel ban imposed by the government which affects your travel dates (not the destination) –

Up to 14 clear days prior to travel date –

  • Cancellations – Full refund (Excluding the booking amount, IF applicable. Security deposit (IF paid) shall be completely refunded.
  • Rescheduling – No change fees. New travel dates must be within 30 days from the date when travel restrictions are lifted. New dates subject to availability and fare difference if applicable will need to be paid.
  • However, if the new rental is lesser, no refunds shall be given of the balance amount.

Up to 13 to 8 clear days prior to travel date –

  • Cancellations – 50% rental will be retained by us (Excluding the non refundable booking amount, IF applicable). Security deposit (IF paid) shall be completely refunded.
  • Rescheduling – No change fees. New travel dates must be within 30 days from the date when travel restrictions are lifted. New dates subject to availability and fare difference if applicable will need to be paid.
  • However, if the new rental is lesser, no refunds shall be given of the balance amount.

Up to 7 clear days or less from travel date –

  • Rescheduling – No change fees. 100% of rental paid plus booking amount (if applicable) can be used towards new travel dates. New travel dates must be within 30 days from the date when travel restrictions are lifted. New dates subject to availability and fare difference if applicable will need to be paid.
  • However, if the new rental is lesser, no refunds shall be given of the balance amount.

After commencement & during travel –

  • Cancellations – 100% of total Trip price will be retained by us. Security deposit shall be refunded after making deductions IF applicable.
  • Rescheduling
    • Client can choose a different destination if possible. In case of travel to a different state Boondockers shall put in every effort to procure a fresh special permit for the new state if possible.
    • Change of dates – No change fees. 100% of rental paid plus booking amount (if applicable) can be used towards new travel dates. New travel dates must be within 30 days from the date when travel restrictions are lifted. New dates subject to availability and fare difference if applicable will need to be paid.
    • However, if the new rental is lesser, no refunds shall be given of the balance amount.
    • Any costs incurred in this scenario (including but not limited to – fuel, special permit, taxes etc.) shall be adjusted towards the refundable deposit.
  • Refundable Security deposit must be paid by or before 24 hours prior to the start time of the trip.
  1. PAYMENT PROCEDURE:

Electronic transfers must be in favour of BOONDOCKERS entity as listed on the relevant quotation provided by BOONDOCKERS. Payment by cheque will be subject to realization.

  1. RESPONSIBILTIES:

THE TRAVELLER SHALL:

    1. Promptly comply with any reasonable instructions given by Boondockers/Driver
    2. Ensure they take out comprehensive travel insurance covering them for personal effects, personal accident, medical and emergency travel expenses, cancellation and curtailment
    3. Ensure they have the necessary Government ID, correct passport, visa and vaccination or medical tests.
    4. Understand that in some cases their travel may take them into regions that are in close proximity with wildlife. Travellers will be required to sign a conditions and waiver form at the time of their trip
    5. The Traveller shall at all times be solely responsible for ensuring that all payments due to BOONDOCKERS are paid timely to BOONDOCKERS in accordance with the provisions herein
    6. Shall not carry more passengers or any other passengers than what is mentioned in this contract.
  1. Will be responsible for any damage to the interior or exterior, including the amenities of the CAMPERVAN, i.e. equipment, fixtures and fittings and damage caused by improper use or due to negligence in operation. In all cases traveller will be charged for the damage, any repair costs as well as up to 100% of the per day rental cost for the number of days the vehicle will be non-operational due to repair work.
  2. Understands that Boondockers will undertake no claims for loss or damage to personal belongings or valuables of the traveller or any person or persons.
    1. Campervan are  registered under surface and Regional Transport office ‘RTO’ where it does not allow passengers to use alcohol or drugs inside the campervan, while campervan is moving or stationery. Travellers are solely responsible for all costs/fines and expenses incurred because of offences under the influence or keeping of alcohol or drugs inside the vehicle.
    2. The campervan is STRICTLY non-smoking and every incident will attract a fine of INR 10,000/- along with blacklisting of the said Traveller/s

BOONDOCKERS SHALL:

  1. Assist in planning & arranging itineraries wherever required, relating to the trip.
  2. Stipulate all campervan types, accommodation, specifications.
  3. Be entitled to change travel arrangements, accommodation and arranged activities due to unforeseen circumstances after the itinerary has been issued. Should this occur BOONDOCKERS would inform the traveller. Every effort will be made to operate the Trip as planned
  4. Make every effort to secure special requests, however these cannot be guaranteed
  5. Ensure that all brochures, advertising material and other documents of whatever nature supplied to the traveller are accurate and fully comply with all applicable laws, regulations, rules and codes of practice
  6. The Company will accept liability for the negligence of its own employees causing direct physical injury to passengers only to the extent as specified under Indian law. We cannot be held responsible for any other mishap to yourself or your property, and in particular for the consequences or effects of strikes, wars, robbery, sickness, mechanical breakdown, quarantine, Government intervention or other such happenings. Passengers travelling on vehicles owned by Boondockers are covered by vehicle liability insurance only and by accepting an email you acknowledge that the Company has taken all reasonable steps to safeguard its liability in this respect.

BREACH:

The Travellers and Boondockers shall be entitled, without prejudice and in addition to any rights which they may have in terms of this Agreement or in Law applicable within the Applicable Jurisdiction forthwith to cancel this agreement or to uphold this agreement and in either event to claim such damages as it may have suffered in the event that the other Party defaults

  1. WAIVER AND INDEMNITIES:
    1. The term “Traveller” shall include the Traveller and its assignees, and/or successors in title.
    2. The term “Claims” shall include all and any claims, payments, demands, actions, causes of action, losses and expenses, including all and any future and unascertained damages.
    3. The term “Third Party” shall include any party who does not have a direct connection with this agreement but might be affected by it, and includes Third Party Service Providers.
    4. The term “Third Party Service Provider” shall include any party who does not have a direct connection with this agreement who has been engaged to carry out and operate part of the Trip.
    5. The term “Third Party Claim/s” shall include all and any claims, payments, demands, actions, causes of action, losses and expenses, including all and any future and unascertained damages that any party who does not have a direct connection with this agreement but might be affected by it.
    6. The Trip or part thereof may be inherently dangerous, including but not limited to visiting isolated regions, being in close proximity to wildlife, chartered Travel & participating in various activities.
    7. Parts of the Trip may be carried out and operated by Third Party Service Providers and that BOONDOCKERS does not accept any responsibility for the performance of these parts of the Trip.
    8. Travellers may be required to accept additional terms and conditions, which may include  exclusions or limitations of liability before commencing certain activities or embarking on certain travel.
    9. Safekeeping of baggage and personal effects shall at all times remain the Traveller’s responsibility and that BOONDOCKERS assumes no liability for lost or damaged baggage,
    10. The Traveller hereby agrees to hold BOONDOCKERS harmless from for and against all Claims, either directly or indirectly or by any Third party or Third-party service providers, arising from this agreement, Booking, The Trip or any part thereof.
    11. All and any statutory or strict liability.
    12. All and any negligent acts (excluding gross negligence) or omissions of BOONDOCKERS
    13. All and any acts or omissions of any other party, including but not limited to Third Party Service Providers (not limited to negligent acts)
    14. All and any extraneous events including but not limited to rain, storm water, hail, lightening, fire, riots and strikes, curfew, pandemics.

FORCE MAJEURE:

  1. If either Party is prevented or restricted directly or indirectly from carrying out all or any of its obligations under the Trading Terms for any cause beyond the reasonable control of that Party (including without limiting the generality of the a foregoing: war, civil commotion, riot, insurrection, strikes, lock-outs, fire, explosion, floods and acts of God), the Party so affected shall be relieved of its obligations hereunder during the period of that event and shall not be liable for any delay or failure in the performance of any obligations hereunder or for any loss or damages which the other Party may suffer due to or resulting from such delay or failure, provided that written notice of the inability to perform shall be given by the Party so affected within 48 (forty eight) hours of the occurrence constituting force majeure.
  2. The Party invoking force majeure shall use its best endeavors to terminate the circumstances giving rise to force majeure and upon termination of these circumstances giving rise thereto, shall forthwith give written notice thereof to the other Party.

 DISPUTE RESOLUTION:

  1. In the event of any dispute, controversy or claim (a “Dispute”) as to the rights and obligations of the Parties or as to any other matter arising from or out of or that in any way is related to the terms, including any question as to its existence, validity or termination, the Parties shall attempt in good faith to resolve the Dispute between themselves.
  2. If the Parties are unable to resolve a Dispute by mutual agreement within 14 (fourteen) days after the Dispute is first communicated in writing by any Party to the others, then the Dispute shall be submitted to and decided by arbitration in accordance with the Applicable Laws governing arbitration proceedings within the Applicable Jurisdiction, Pune, India
  3. The provisions of this clause shall not preclude any Party from access to an appropriate court of law for interim relief in respect of urgent matters by way of an injunction, or mandamus pending finalization of this dispute resolution process.

GENERAL:

  1. If any provision of the Terms is rendered void, illegal or unenforceable in any respect under any law, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby.
  2. The Traveller acknowledges that, subject to Applicable Laws, BOONDOCKERS may electronically collect, store and use personal information, including the Traveller’s name/s, contact details, email addresses, IP addresses etc. for the purpose of carrying out any Trip and will acknowledge that BOONDOCKERS may retain such personal information for as long as is necessary or legally required in order to render services under the Trip or as may be required to comply with relevant statutory obligations under Applicable Laws
  3. Except to the extent of its own gross negligence, recklessness or willful misconduct, BOONDOCKERS will not be responsible for any damages suffered by the Traveller as a result of the transmission of confidential or other information disclosed to BOONDOCKERS through the Internet.

NOTICES AND ADDRESSES:

NOTICES:

  1. Any notice, consent, approval or other communication in connection with this agreement (“Notice”) will be in writing in English.
  2. Each Party chooses the email address corresponding to its name below as the address to which any Notice must be sent.

  4. Marked for the attention of: Boondockers Team
  5. The details provided by the Traveller as his/her/its physical address and /or email provided by the Traveller at the commencement of the Booking process
  6. Any Party may by Notice to the other Party change its address and/or the person, if any, for whose attention any Notice must be marked

BREAKDOWNS:

  1. Problems encountered with the vehicle or equipment must be reported to Boondockers On-board Staff (driver) to give them an opportunity to rectify the problem within the rental period. In all cases, the responsibility of the company is limited to refunding for the time that the vehicle was actually in repair. No alternative accommodation or food items will be paid for during down time.
  2. Malfunction of Radio/Cassette/DVD players, LCD’s, Videos, Microwave, Inverter, Stove/Gas range, Grill (any other kitchen accessory), Air-conditioning units, Fridge, Water heater, Water pump, Water filter, Winch, 12/240 Volts Alternator or any other gadgets are not considered mechanical breakdowns and downtime will not be paid for these items.
  3. On campervan holidays, the lifestyle is very different and events are much less predictable than on a conventional holiday. Health, safety and operational standards-particularly of wild camp sites are not up to the western levels. However good our organization is, we are at the mercy of the unexpected and our statements are of intent rather than promises. Local weather, politics, transport (vehicle breakdown) or a host of other uncontrollable factors can mean a change in itinerary or means of transport. It is unlikely that the itinerary would be substantially altered, but if changes are necessary the driver will decide the best alternative, after consultation with the group. If any delay or change does occur, we will do everything possible to minimize its effects, but we cannot be held responsible for the results of delays or changes outside our control.
  4. Finally, crime and other security risks exist practically all around the world. Travelling in a group is a safeguard, but not a guarantee. Though we will take all reasonable care of you, but we cannot do this adequately if you do not at all times take appropriate precautions yourself.
  5. Any information or advice provided by the Company on matters such as permits, visas, vaccinations, insurance, climate, clothing, baggage, special equipment, route details, guided tour itinerary etc. is given in good faith but without responsibility on the part of the company and the passenger accepts responsibility for obtaining any necessary travel documents required for the tour. All Indian nationals must carry a valid government issued photo ID proof and all foreign nationals must carry a valid passport and VISA.
  6. Any kind of pre medical conditions/illness like high BP, Diabetes, dizziness or mountain sickness (minor or major) should be disclosed at the time of booking. All the related medicine and aid to be procured by the traveller before the commencement of the trip. Boondockers will be providing the basic first aid kit only.
  7. If you have any complaint about the tour, you should make it known at the earliest opportunity to the driver who will normally be able to take appropriate action. If you are not satisfied with his response and you feel your enjoyment of the tour is likely to be significantly affected, you should notify our head office in Pune and we will do our best to resolve the problem.
  8. Your booking is accepted on the understanding that you realize the inconvenience and discomfort involved in this format of travel. The whole philosophy of this format of travel is one which allows alternatives and a substantial degree of on-tour flexibility. Itinerary given for each guided tour must therefore be taken as an indication of what each group should accomplish, and not as a contractual obligation on the part of BOONDOCKERS. For any guided/organized/customized tours by any individual, change in itinerary may be caused by local political conditions, weather, border restrictions, sickness, mechanical breakdown or other unforeseeable circumstances. No refunds will be given for services not utilized. It is a fundamental condition of joining any of the Boondockers  tours described in this site that you accept this flexibility, and acknowledge that delays and alterations and their results, such as inconvenience, discomfort or disappointment are possible.
  9. On an adventurous tour it is necessary that you abide by the authority of the driver, who represents the company. Accepting our terms and/or signing our booking form signifies your agreement to this, and if you commit any illegal act on the tour which would cause danger, distress or annoyance to others, we may terminate your travel arrangements with immediate effect without any liability on our part.

COSTS:

All and any costs incurred by either Party arising out of or in connection with a breach of any of the provisions of the trading terms by the other Party, including but not limited to legal costs on the attorney and own client scale, shall be borne by the Party in breach.

SEVERABILITY

  1. All provisions of this agreement are, notwithstanding the manner in which they have been grouped together or linked grammatically, severable from each other.
  2. Any provision of this agreement which is or becomes unenforceable, whether due to it being void, invalid, illegal, unlawful or for any other reason whatsoever, shall, only to the extent that it is so unenforceable, be treated as pro non scripto and the remaining provisions of this agreement shall remain of full force and effect.

ENTIRE AGREEMENT

Subject to the provisions of this agreement, no alteration, variation or cancellation by agreement of, amendment or addition to, or deletion from this agreement shall be of any force or effect unless in writing and signed by or on behalf of the Parties.

JURISDICTION AND GOVERNING LAW

  1. These terms of use, which are subject to Indian law, contain the entire agreement between us with respect to our site. No part of these terms & conditions are intended to constitute an exclusion of any liability which cannot be excluded under Indian law.
  2. This agreement is governed by the Indian laws. Any dispute will be settled in the court of Maharashtra only.
  3. Our staff, is one of our key assets and are very carefully selected & trained to ensure that your trip is trouble-free & as enjoyable as possible.

COUNTERPARTS:

This agreement may be executed in counterparts, each of which will be deemed to be an original of this agreement with the same force and effect. A facsimile or photocopy of a fully executed counterpart of this agreement, or of a set of identical versions separately executed by the Parties, will be valid evidence of the existence and the terms of this agreement.

The terms “We” / “Us” / “Our”/”Company” individually and collectively refer to Boondockers and the terms “Visitor” ”User” refer to the users.

INDEMNITY
The User unilaterally agrees to indemnify and hold harmless, without objection, the Company, its officers, directors, employees and agents from and against any claims, actions and/or demands and/or liabilities and/or losses and/or damages whatsoever arising from or resulting from their use of letsboondck.com or their breach of the terms.
